    Hi all,

    Does anyone know how to calculate damages in the case of a negligent solicitor providing incomplete legal advice, or does that fall under 'loss of chance'?

    Hi,

    The purposes of damages are to put the victim in the exact same position if the contract had been fulfilled, in this case the solicitor would have to pay this difference. Loss of chance is similar, however is only applicable if this incomplete legal advice prevented you from a benefit or avoiding a loss. My advice would be to first go through the solicitor's complaint procedure, however if this does not yield the desired results you should contact the legal Obudsman to adjudicate a case in which a solicitor was negligent which may yield some compensation. However, if you wish to receive full damages in court you can pursue a negligence claim, which can be more costly to fund.

      Thanks for the input.

      I've complained and escalated that complaint to the Legal Ombudsman (whom I have lost confidence in). They completely overlooked that important aspect of my complaint, and argue that matters concerning negligence are nothing to do with them (seemingly even if this amounts to poor service).
