  • Royal Mail delivered to wrong house

    Hi I sent a radio that a lady had bid and paid £71 for on Ebay.
    I sent it to her Royal Mail 2nd class signed for.
    She messaged me 5 days later asking when I posted it.
    I checked the tracking and it said delivered and signed for 2 days previous.
    I finally got through the next day with RM customer services.
    The guy checked the GPS and found the delivery was signed off 300 yards away from my lady's address, he was shocked and also said their employee hadnt signed it off correctly by not putting her name and address on the hand held device, also the signature was nondescript and could've been signed by him.
    He set up an investigation which would involve the employee attending a meeting with his depot manager to explain himself.
    RM were supposed to get back to me with their findings (they didnt) I ended up ringing them.
    They said the employee involved couldn't remember much about it and couldn't throw any light on it and I would have to go through the complaints procedure.

    My problem with this whole scenario is :
    This is not a missing parcel, it was delivered nowhere near my customers address it was given to somebody else or left somewhere it shouldn't have been.
    Why if he couldn't find the address at least ask or even take it back to the depot?
    I am doing this to investigate on behalf of the lady who is a bit upset, but at the same time I have a tracking letter from RM saying delivered on a certain day at a certain time with a signature.
    Is the onus on the lady to claim on this now?
    As I have confirmation of delivery and a signature (not hers) Also I have her money.
    So if she claims she'll get reimbursed and I won't lose out if I claim and I have to reimburse her?
    Also as far as I see it, what the employee has done is a dereliction of his duty and tantamount to theft?
    Any help and thoughts on this is appreciated.
    I am yet to get back to the lady with my findings.

    The delivery contract was with the Royal Mail and you and so the recipient is not party to it.

    You must claim against Royal Mail.

    You should also consider refunding her money as the process may be long.

    Also note :- Every Signed For 2nd Class item is covered against loss or damage up to £50 or the value of the item, whichever is lower.

      Obviously not followed by this particular postman.
      I would be insisting on refund of full value plus postage plus any other costs incurred.
      Viewing RM reputation you will probably have to get pushy

        I did think it amounted to theft really
        I got in touch with the local police for her area and they agreed and they asked for me to forward all my details and ref numbers to the lady and for her to get in touch with them and they would would take it up with RM with a crime number etc.

          Hmmm. If I were your buyer I don't think I'd be satisfied if that is all you are going to do. As pointed out above any contract for delivery was between you and RM. The item you sold is at your risk until it has been safely delivered to the buyer. It is your responsibilty to chase this up with RM, you shouldn't be passing it onto your buyer. (Getting the police involved does not discharge your responsibility to your buyer.)
