  • Deposit rip off?

    n December 2019 I paid £100 deposit on a caravan holiday in August this year. Yesterday the caravan owner telephoned me saying he was closing the site due to Corona virus but could 'roll my deposit through' to summer 2021. I declined the offer and asked my £100 deposit be refunded. However he refused saying the booking form clearly stated deposits are non refundable! I said 'but you are cancelling my holiday' however he was adamant he would not return my money.

    Likely to be an unfair contract term.

    You can send him a letter before action and threaten legal proceedings if the amount is not paid within 14 days. Either he will call your bluff and you take it further or he will pay up.

    If you paid by credit card you could claim it back through your credit card provider and if they refuse, sue both of them.

    Of course that also depends on what the rest of the terms say about cancelling and refunds.
