    All sorted, I think.
    The bank agreed to pay back the charges.
    Double Take rang her to ask why she had cancelled and what was happening about the payment. Kya explained what had happened and that she had always said she wouldn't be able to make the date, but was told she could change it.
    This woman said that was right, she should've been able to postpone and sounded quite annoyed that this hadn't been done. She wanted to know exactly what time she phoned so she could find out who my daughter had spoken to.
    So all happy now and a lesson learnt - never pay with your card over the phone!!

      They have taken the money again!
      Kya rang the bank and asked how they could as she had cancelled the card? They said that it's only the first 8 digits used and they were the same! She asked what the point of cancelling the card?
      And the bank said that it wasn't them that retrieved the money, it was Double Take that repaid!
      The bank said that there is nothing they can do as she gave her bank details over the phone, which means she has promised to pay as much as they want to take as often as they want to take it!! Regardless of her saying this isn't so, the bank just repeat that by giving her details away to this company she has made a commitment to them.
      She has rung DD and demanded they repay the money, explained that she has no gas, a single mum etc and they are 'looking into it'.
      If the money gets repaid she is going to close this bank account so it can't happen again. At the moment she can't close it because it is over-drawn now because of this.
      They only apologised for doing this yesterday then did again!!!
      This is madness.

        Stop phoning them, write to them and demand they stop requesting money from the account. Threaten them with trading standards and a complaint to the OFT regarding unfair terms

(ix) If you breach these Terms and Conditions and DTS ignores this, DTS will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions. (x) DTS shall not be liable for any breach of these Terms and Conditions beyond its reasonable control. (xi) A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
        Also threaten that you will serve a claim against them for any additional costs/distress caused.

          Oh what gits!

          I think it was them that called me a few years ago saying I had won a free make over and when did I want to come in...then after getting me all excited they demanded I give them my credit card details and give them a £100 deposit for my FREE makeover. The bloke on the phone got really agressive with me when I refused to. I told him he couldnt have any money for something that was free, he said he would refund the money if I showed up! I ended up hanging up on him, he was really quite rude.

            Don't know if this section of their T & C's are of any help.

            If she rang straight away on receiving confirmation of the booking, cancellation should be free and she should also get her £2.00 deposit back(which they omitted to deduct from the fee)

            (ii) Appointments can be cancelled free of charge within 7 days of receiving confirmation of your initial booking.
            After 7 days of receiving confirmation of your booking, cancellations are subject to a £125* per appointment administration fee. This is to cover the cost of the creative team that have already been booked especially for your appointment.

            *Any deposit already paid will be deducted from these administration fees.

              Jules I ignored you! lol
              I rang them, ripped in to them without swearing or shouting.
              Threatened that if they did not return the money by today I would let everyone know how they had ripped off my daughter, a single parent to a young child, that I belong to three major consumer sites who would be very interested in what I have to say about them, in particular Martin Lewis and put all the details across Facebook. Also I would be contacting Trading Standards as they obviously are ripping people off, not giving the correct information over the phone.
              The woman was quite taken aback by my outburst without breath!
              She apologised, said she didn't know why it had happened but it shouldn't have and the money would be back as soon as possible.
              Today it was.
              This has been absolute madness.

              Concerned about Barclays saying once you have used your card details over the phone, that person is free to use it whenever they like, for however much they like, as often as they like and you can't stop it happening even by cancelling the card.
