Again irrelevant. The contract you sign up to governs the applicable laws and where you can file a claim. You don’t get a right to arbitrarily disregard the terms you agreed to because you now don’t like them.

I feel like whatever I say is not getting through to you so I’ll bow out of this and wish you luck.

So I started my claim against their 100 New Bridge St, naming the correct entity ie Air BNB Ireland UC.

Emailed requesting default judgement last week, form N244, the day after acknowledgement was due.

Just been emailed back the following:

"Thank you for your letter which included a Request for Judgment on behalf of your client in the above named case
Unfortunately, I am unable to process this because the defendant’s address is out of the court’s jurisdiction
To enforce this Judgment you are required to complete form N244 application and pay the appropriate fee of £100.
Please complete and return the application, together with the attached document, as soon as possible to avoid any further delays."

I have been told that they got their acknowledgment of service in on time, requesting an update to the address to their Irish address.

But I am confused as to why/what the application would be for, exactly?

Also, can I not ask that the London address continue to be used, moving forward? As they clearly are receiving mail there.

      des8 ? Help!

The court rules for service of proceedings out of jurisdiction post-brexit have undergone changes, so i suppose you had better comply with court instructions

It seems that you initiated your claim against the Irish branch, and the UK payments office forwarded the papers to Ireland.
Irish office have acknowledged claim but pointed out their correct address, which is outside the court's jurisdiction, so your application for judgment needs to be amended.
Of course you will now have to enforce the judgment (if you are awarded it as they have acknowledged the claim).
Or of course they might also apply for set aside .if your application for default judgment is successful

Still don't think you have a viable claim and you're still throwing good money after bad

Okay, does this mean I can still have the case allocated to my local Court in the UK?

Probably but did the acknowledgment include a defence or dispute the court's jurisdiction?

Well they filed no Defence - but made an application to strike out my claim, and asked for summary judgement.

Doesn't stand much of a chance, given that it is full of lies. Tellingly, they asked for such without any hearing.

Asked for 28 more days to file a Defence, if their application is turned down.

Which does not seem fair, as Defence was due today.

They also state that "they do not dispute jurisdiction" but added "on this occasion". It is very wordy and I think an attempt to browbeat.

Am I right is saying that if they do later dispute jurisdiction, they can hardly expect to get what they ask for, given that they asked the UK Court to strike out the claim and so therefore consider it?

Also, any advice on how to respond to the application? It is lodged with the CCBC.

So what is the basis for the strike out application?
