  • Advice required please court error on warrant

Hi, my partner is a Sole Trader and has been chasing an unpaid debt through County Court. A warrant was obtained and county court bailiffs were chasing the debtor for 9 months, the debtor then agreed to pay in instalments and the warrant was suspended. The debtor did not make any payments so we requested that the warrant be reissued ( Sept 2015). We hadn't heard anything back so in January this year decided to take the warrant to the High Court. Was slightly unsure of procedure so contacted Money Claim online who informed us there was an open warrant on the case but we'd need to contact our local court to deal with it. We've emailed them several times and initially we received the final paperwork for the suspended warrant. We then called them up and they said yes there was an open warrant on the case and we would need to email in to get it closed before we went to the High Court. I emailed in on 4th March and again on 12th as had not had a reply or even acknowledgment from them. My partner then called them today and we were told that a warrant was started on 28th Sept but never completed so had not been acted upon. This has set us back a further 6 months in chasing this debt. We are so frustrated as the debtor has been selling off his assets (the property where the work was carried out is currently for sale, it's not registered with land registry so do not know if the property belongs to the debtor), we have applied to Companies House to have the liquidation suspended which they have done until April. We are applying to the High Court to have the case transferred up but is there anything we should do with regard to the local court and their mistake as this has cost us vital time?

    Many thanks
