  • Getting clarificaion of the terms of a tomlin order

    Hi,

I as defendant, agreed to a tomlin order. The consent element included not do certain things.

However, I need to do something that I think is not included but could be.

So I asked the claimants and they refuse to state one way or the other.

This leave me with a potential contempt of court issue.

    Q) Can I get clarification from the court as to if I will be in contempt. Does a proces exist for this scenario.

    Thanks
    Randal

As far as I know the order is what it is and the court will not clarify its terms for you.

I suppose you could make an Application setting out what it is you want to do and ask the court to make a declaration that whatever it is is or is not compatible with the terms of the order.

If you want any more specific advice you will need to post the terms of the order and say what it is you want to do.
