Hello

I run a small business and part of that is renting out property.
The tenants have all had problems and not paid the proper rents which should include council tax.

Therefore I make up the difference to cover the mortgage as they behind with that too. Council is getting heavy and iam getting threatened with all sorts and a letter came yesterday from council demanding £1000 per month to sort it out.

I can't afford this at all.

I am faced with evicting them all at this rate but don't want to do this.

Help please if you can

Hi MrsT.

You sound like a very kind person who is being squeezed from both sides!

Your tenants need to pay their way - at least prevent you from paying to have them there, which would appear to be the present scenario.

Have a serious pow wow with them and apprise them of the financial reality.

Thanks for your reply. I have tried being tough but they are all struggling and the only option I have is court action as a few have already threatened to stop paying anything and to dis their heels in. I can't afford court either.

It's a pack of cards waiting to fall down.

I heard and read the council.never take anyone to court per se so should I just dig my heels.in and offer an amount I could cope with bearing in mind we are talking large arrears....

I own/run a himo as wel ( presuming a himo your on about, )l, i was an property agent for 12 years.. dealt with 1000s of tenancys.

Splitting this down in 2 The CT owed, and the tenats rent owed.

Councils can be very hard to deal with in each of these situatiosn., few questions

1. Are and of the tenants on HB, and is any of the arrears due to HB not being paid

2. Whats the arraesr totals for each tenat

3. Whats the total councvil tax thay are asking for, and how many years does that cover.


Also,

what outcome would you want if possible, and what outcome would you settle for

12k over six houses
Council demanding 1k per month or charging order next

I want to pay my debts at a rate my business can sustain
Don't want charging order don't.see the point I have a mortgage and three charges already against my house.
This would just be fourth charge so council wouldn't get penny and we will never be selling our home been here years and years.

What happens to the debt if they insist on co? Any advice would be great.

All I know is they took my case off the bailiff when I stood firm and refused to deaL with them. Simple.

They could go for a SD and try to bankrupt you.

They have called off the bailiff and offered me reasonable payment plan. They realise I don't deal in bailiffs and I stand strong and they are being reasonable. Council officer already said bankruptcy is not an option for them. Got the letter this.morning was at neighbours.
More people should stand up and just keep writing to the council and bypass the bailiff.

If by Kipling. Don't deal in lies it says......and lies is what bailiffs deal in.

In your post number 8 you say that the debts to the council go back to 2011 and are spread over 6 properties and total £12K

Without knowing more detail it would SEEM that you therefore have around six Liability Orders. That is only important because; under the new regulations a bailiff is not allowed to charge multiple fees and therefore, the only amount that Bristow & Sutor could charge you in the event of them making a visit is just £235.

A Compliance Fee of £75 is legally charged to each account.

It would be worth your while asking the council what has happened to the bailiff fees that were incurred up to the time that the council accepted the debt back. Ask they council if the bailiff fees are being deducted from the amount that you are paying them or whether the fees have been written off. Make sure that you get your reply in writing. Can you post back with their response.

That's great thanks. I hadn't thought of that bit. I will ask the council about this soon and post up what they say on here asap.

The second paragraph 're liability orders please can you explain more as I can't fully understand what you mean. Have at around liability orders? Cheers.
