  • Arrears of Rent on Council owned Leased small Business

    Hi All . Not sure if in right section but here is My problem . Have a lease on small business but have been in arrears with rent of late we are paying it off as fast as possible , but times are hard at moment . We have now received letter from council stating that unless we pay a set amount by end of month Sep . we will be evicted . In short their Bailiffs will force entry and change locks and repossess the business .
    My question to you all is where do we stand ? Can we resist their forced reposition if it came to it and do we have any Rights at all . Been there 13 years and had no problems till last two years with rent , 90 % of their stated amount due has now been paid but the worry is still there so could do with some advise , If you need any further info please ask .

    Are you able to put together a written repayment plan, which you know is sustainable, and present it to the council? If they can see the debt is largely repaid, and can see the remainder will be repaid within a short time, they may well accept this.

    Have they been to court over this? :beagle:

      Hi Wolfhound . No not been to court . Have done as you advised and have agreed repayment plan , Council are happy with . But for future reference we would still like to know wher we stand as far as the council breaking in changing locks etc . are there any support groups on this and would this best be asked in Baliffs section ?

        With Commercial Rent there is no need for Court, the LL can just instruct a Bailiff.

          I'm glad you got a repayment plan agreeed, that removes the worry now. Make sure you stick to it and hopefully you won't need our help again. If you do, post in the bailiff section if it directly involves bailiffs, or another relevant section if it pertains to something else. :beagle:
