How did the landlord gain access to details of your partner's customers?
well he wrote a letter to each of them and popped it on the stable doors. He just approached our staff and took a contact.
this is not just a litre stable yard it was voted BD venue of the year in 2019. Which in the equine industry is quite an achievement especially as it’s in a deprived region.
that’s all gone now. Closed down. Finished.
solicitors never called back.

Or do you mean it was just a generic "Dear Customer of xxx stables" type of letter left on the door?
What does "He just approached our staff and took a contact" mean? What did he ask your staff to do?
If you are seeking an injuction this interference with the business is potentially an important matter.

He sent a generic letter to all my partners customers. We’have not seen this letter but have asked for copy.
he has made contact with our staff and arranged to take over then on Monday 15/12
He is on site today doing what he wants. With his security that is to protect care home from burglary but they are on our premises. Signs on our premises. We have to ask to leave our premises.
It’s all about how much notice my partner should have had. Also clearly he can’t install security on the property to prevent us leaving. It’s utter madness his excuses of security for care home. It’s a different location and it’s not even locked.
its harassment and intimidation. There is nothing to pinch of the landlords. I’ll post email he sent to us. To clarify though the care home is next door with separate entrance. No security there at all or locks on gates.

I was hoping to have caught you when I saw you come on to the yard.
We have just installed a welfare unit on the site.
Our building team have surveyed the yard and will be undertaking emergency repairs as from this weekend.
Also, we have had a break-in at the home where they have started to strip out all the copper. They have also forced access into other areas, so as of today we have engaged onsite security to man the whole site.
I would appreciate if you could confirm the 11th or 12th as previously emailed for the handover.
If you are wanting to move any items before the 15th, please let me or Cristian on the email above know and we will ensure that security lets you move them. If by the 15th you have any of your items that you are unable to move I will be happy to discuss further with you.

This is a copy of the notice to end her lease 2/12
hope you are keeping well.
It has been some time since we last communicated and unfortunately there has not been any progress with Geoff and the acquisition of the site.
Knowing that the overseeing of the equestrian centre by yourself was to be a temporary arrangement and that there is no prospect of the sale completing, we have taken the decision that Manor Homes will take over the operating of the site from Monday the 15th December.
Therefore instead of undergoing a handover with Geoff, I would appreciate a handover with our team either on Thursday 11thDecember or Friday 12thDecember am.
Also, in the interest of continuity we are happy to retain your existing staff.
I assume that you will advise the liveries of the handover and for completeness we will hand out introductory letters detailing contact information, new account details and an assurances that their livery facility will be unaffected.
Since our last discussion, I am assuming that the muck pile has now been dealt with.
Thank you for your support and just let me know your preferred date for the handover.

I'm still don't understand what happened. If he sent a letter to all your partner's customers he surely must have had their addresses? So how did he get them? The identity of your customers is the confidential information of your partner's business. These are things you need to disclose to any solicitor you are consulting as you may want your injunction to also prevent him contacting your customers.All opinions expressed are based on my personal experience. I am not a lawyer and do not hold any legal qualifications.

Spent all day trying to make contact with a solicitor. All I really need to find out what notice period should have recieved and format
and what can be the consequence of not giving correct notice.
not sure we want to go back. We have sold everything and he’s taken over. The security was to manage that. Quite unbelievable really and reading his emails to my partner. It was if she was providing a service not having a lease.

Here’s another email from landlord. He’s only bothered how his take over is going to go
Just to confirm that we will still run the shows and honour the bookings etc.
We will be on site on 11th December and would appreciate before then a schedule of liveries including charge rates etc.
Also a schedule of the current bookings that you have and the fees you have agreed plus any deposits or payments made to date.
Details of current staff with pay rates.
We will aim to make the transition as smooth as possible with the minimum of inconvenience and stress for your staff and the liveries.

Well I’ve tried but been very unsuccessful . Can’t get a call back or anything. Even the firm I’ve always used,he’s moved on and they did not replace him. Say the do commerial on website but don’t.
so Ai tells me this- Unprotected/Contracted-Out Lease: The tenancy ends automatically at the fixed term; if the tenant holds over, they become a trespasser (landlord can take immediate possession) or may form a periodic tenancy if rent is accepted (avoid this)

Well I’ve called so many today. General consensus is they are too busy to take work on or they don’t do commercial anymore.
I’ll start again tomorrow.
