  • Unpaid invoice

    My husband is a sole trader and is still waiting for payment from a company he did a job for. He went in on a Saturday so as not to disturb the office during the working week and replaced damaged flooring. He was there roughly 8.5 hours and did what was required of him. He put in his bill for £310 pounds - he normally charges day rate of £250, but usually £300 if on weekend/bank holiday. He still only charged £250 despite it being a Saturday, plus £60 for materials. When he put his bill in, the woman started shouting that it was extortion and she was arguing saying she couldn't believe that is what he was charging her. He explained that £250 was the going rate and as it was the weekend it was actually a competitive price. She said she would pay it, but it was extortion.

    I sent the invoice on 2nd August, a follow up on 26th Aug but haven't received a response. She has spoken with the shop that arranged for my husband to do the work and he explained that it was the standard rate, and was on par with what he paid his fitters.

    I've asked politely twice, but I really just don't know how to follow this up. I want to make sure I get it, but I'm not sure how to progress - my husband has never been spoken to like that before on a job in over 25 years and he was really shocked. If someone could give me some pointers, I'd really appreciate it. It's hard to know what to say, but I want her to be sure that I'm not prepared to let her just ignore and not pay. I don't know whether to give a time frame, amd just what to threaten with if still ignored. TIA

    Issue a Letter of Claim and if still unpaid start a small claims court claim via MCOL.

      Did your husband agree a price before doing the job?

        On this occasion, he didn't. The shop he sub contracts to had asked him for his input because it was an unusual job so he went in on the Saturday, assessed and then completed it. She wasn't there to discuss it and she was happy that the job would be competed that day. He simply charged her his day rate, which as I said is a good price for a day's work and she has had ample time to ask around to confirm this.

        Today is the 30th day and still no contact or payment. She has her floor repaired and is using it daily, so surely she should be paying?
