    Hi Legal beagles.

    I have written to another Ltd company, being Ltd myself.

    Firstly I am unsure where the hearing venue takes place? Do we meet in the middle?

    Secondly it is a fast track matter - the Defendant has not replied whatsoever to two letter before actions and we are going to proceed with Proceedings very soon

    The dilemma being, if we were unsuccessful at Court- we would look to argue our costs should be paid in full or at least part given the Defendants total lack of reply therefore having no choicd but to initiate proceedings.

    You are not limited yourself. You are the shareholder and/or director of a limited company.

    The court will decide the venue. This may be your local court.

    Your argument about costs may work if you withdraw promptly after service of defence.

    Have you checked the status of this other company and its ability to pay?
