  • Commercial lease - sale of property/new landlord

    Hello,

    We took out a 3 year commercial lease on a warehouse and are currently 1.5 years in to it. Unfortunately due to the economical impact of covid etc we have been struggling since January. I have read our lease and we do not have a break clause in it to end the agreement early.

    It has come to my attention that the whole property is being sold by the current landlord. Since our agreement was with the previous landlord would we now be able to end the lease sooner?

    On another note there was a bit of rubbish left outside our unit (which we had booked in to be removed). The landlord had the rubbish removed and has now sent us an invoice for £500. The items were an old sofa and a large bag of rubbish. This seems very high to remove a bit of rubbish. Would the landlord have had to notify us prior that this was taking place or at least given us a chance to remove it?

    The unit has been leaking water from various places and we have raised a complaint about it on multiple times. It never gets repaired and a lot of our stock has been damaged a few times. In the end we have turned off the water mains at source to prevent this from happening. We did not pursue costs for damages so it is really unfair they are charging us so much for removal of rubbish.

    Any advice would be hugely appreciated.

    Sorry, but sale by the landlord will not give you the opportunity to terminate the lease early.
