Agent Withholding Money

Hi, I have moved to another letting agent and the previous agent has withheld money from the rents received without the right to do so. He has deducted his mouse clicker fees which is ok but he has also withheld other money without any reason.

I will need to go to the small claims court to get it back. What is/are the rights of action? There is nothing explicit in the contract that says "the agent will transfer the rent to the landlord". Is there anything in contract law or agency law?
