Verbal Contract

Evening all,

I will not bore you with the details but basically I am a small business owner and have been stung by an energy company who say they have a verbal contract with me whereby I agreed to a contract over the phone.

Me trying to get out of the contract is now becoming rather messy and basically I want to access a copy of said recording. However I believe the energy company will just ignore my request.

Do they legally have to provide the recording? And if they don't, what would you suggest for me to try and obtain a copy from them?

Any help is greatly appreciated.

you do have a right to the recording, as well as a 14 day cool off period.

You will need to submit a SAR request to the company, which is a fee of £10. Sometimes the threat of this is enough to have a company run tail between their legs.

Thank you so much for getting back to me.

Unfortunately as this is a B2B contract I do not believe there is a cooling off period.

However I will definitely look into the SAR request. Thank you for your help!

You're welcome!

If you took the contract over the phone it is normal practise to have a cooling off period, you cant "see" the product or the paperwork they should have sent you to confirm (even if it is just an email).

If they say your call was not recorded (never is when a complaint is made) then ask to see the note where it clearly states the time, date and agent you spoke to AND that the correct confirmation paperwork was sent. The SAR will cover that.

Sorry the replies are a bit hit and miss, I am doing what is known as a "Long week" at work and don't know my left foot from my right at the moment.

Once I have woken up a bit, I can be a bit more forthcoming with technical terms (just cannot think of them atm) which will really put the fear of God in to them!!
