  • B.O.S refusal on PPI and significant non compliance to SAR

    Have tried a PPI claim on a card which was originally with Capital Bank but now with B.O.S.
    I've come to the end of my claims appeals with them as they have continually refused to accept liability.
    I therefore made a SAR to them around July last year which I expected to prove my point. I have written to them, called them and complained to them several times on their non compliance in attending to the SAR. They did send me my card statements and a copy of the original application but nothing else I asked for. I continued in this and around a fortnight ago I actually got another bundle of stuff that still doesn't give me everything I need and that they ought to hold.

    From what I can see, the application is marked with an X for a signature against the Credit Care box which sort of substantiates my reasoning that it was pre-filled at the time of card application.

    I'm doing an Ombudsman appeal now but need to know whether I need to submit a calculated amount of claim for the PPI, or can I just make an appeal based on mis-selling and if successful rely on the ICO to tell B.O.S. to do the maths.
