  • Claim for Statute Barred from HPH2 Ltd

    Received a claim for a loan which I taken out in Feb 2009, Shortly after I took out the claim I was made redundant and have never paid any th in towards the balance. I have also checked my credit report which confirms that no payments have been made since the loan was taken out.

    I filed a defense immediately stating the debt was now statutory Barred under the limitations act as I have not acknowledged the debt in over 6 years. it's been about 5/ 6 weeks since I entered in my defense but today I have received a Directions Questionnaire.

    Questions tho, why the need for this as the debt is statute Barred.

    The comoany "Hoist Portfolio Holding 2 Limited" don't exist with companies house and after a Google cant find anything else official about the company. (Debating buying the name from companies house just for a giggle to wind them up to be honest and telling them not to use the name)

    how can I serve them with the DR if they have no official address.

    Have they not got to be registered with the ICO, FSA etc.. To chase a debt under a cca.
