I am writing out a story on behalf of my mother as she doesn't speak English or simply cannot deal with it.
My mother has been a victim of domestic and sexual violence, she was living with a very controlling and abusive man. Now, they have separated in 2012 after my mother had become a victim of strong actions of domestic and sexual violence from him. He was given bail conditions not to enter London or approach her. Now, after separation, my mother had found out that he had set up a contract on her name which is linked to her bank account and also opened credit cards on her name and spent money on it.
Everything was reported to Police as well as Three mobile and Aqua credit card to let them know that she was a victim of fraud and identity theft. After investigation, Police couldn't do much as there wasn't enough evidence to proceed with the case. Aqua credit card company have done their investigation and treated it as fraud.
However, Three mobile have done their investigation and said that it cannot be treated as fraud as all details match. Now, back in 2012 I was onto their case chasing them up and trying to resolve the manner, after some time they have agreed that the voicemail is male voice and they agreed to cancel the contract and write off the debt. Now, in 2013 they have called us and sent us letters that we are liable to pay the money for contract and instantly I was onto their case. Eventually after days of arguing, their manager called me and said that they agree to write off the debt as a "goodwill", however he will have to put a mark on the credit history. My mum has agreed with it, as those letters simply were terrorizing her and harassing her and reminding her of the horrific events she suffered from her husband.,
Now, after more than a year since I thought the matter was settled, they have wrote to letter to us. The letter looks like a three letter but it gives numbers of Lowell Portfolio Ltd and it says that we need to pay:
Arrears: £107.20
Early Termination Fee: £456.02
Balance Outstanding: £563.22
This letter have completely shocked mum and literally caused her to have emotional breakdown. I called Three and was being passed from department to department, where in some places they said that they can see that debt was written off and then reinstated and sold to Lowell, then when talking to end team or customer services, they say that they never written it off and that they always said that she would be liable to pay the debt. Their manager just called and said that they couldn't do anything and that I need to speak to Lowell. I have tried to explain to them that she was a victim of FRAUD, however I was told that it cannot be treated as FRAUD as all details match. Of course they would match, as it was her husband that did it! They weren't cooperating and I said that I will be writing to head office and customer services.
I don't know what to do, please help! I am lost for words and I am completely devastated.
