Hi I am looking for someone advice. 15 years ago I got involved with a scheme ran by some solicitors that claimed they could write off debt under the credit consumer act. The solicitor began the procedure and requested that the lender provide proof of me owing the debt. The lender could not provide a signed credit agreement and we were going down the route of removing the debt. Unfortunately the solicitor doing the work went bust and I was too far down the path of getting this debt removed that everything went quiet, I stopped paying and ultimately it led to the debt been sold on multiple times. One of the companies that bought the debt ended up taking me to county court. I challenged this and informed the court that they could not provide proof I owed the debt in terms of there was no signed credit agreement. Again everything went quiet but later I discovered the court had imposed an interim charging order on my property. My challenge seemed to have gone missing and the court referred the case to my local court where the case went dead. I was stuck with an interim charging order that was never finalised along with a ccj. The ccj has long expired but I'm stuck with an interim charging order. I still have copies of my challenge against the lenders and court. Ive been out of the country for many years but now I'm back I want to get the issue resolved. Any idea where I should begin. I was thinking about starting off by completing a form to get the order set aside! Does anybody know where i would stand with this old debt that I deem unenforceable and where my ccj has expired? Could the lender still come after the debt after all these years with them having an interim charge? Why was a final charging order never made? Any advice is greatly appreciated.
