I had a Barclaycard Motor loan back in May 2004. However in 2005 I had to give up work to care for my disabled son so was in receipt of benefits. I was making reduced payments to Barclaycard who despite me having the arrangement in place still issued a Default Notice in June 2005. My file was then passed onto Lewis Debt Services who agreed a token payment of £1 a month in view of my financial hardship. I have been making this payment since September 2005 via Direct Debit. I then received a letter in January 2014 advising that they are no longer dealing with the matter and that it has been passed to Firstplus. To be honest I didn't really read the letter properly at the time so have continued to pay the £1 a month to Lewis Debt Recovery who I understand have passed onto Firstplus. I have received no communication from Firstplus at all. However, on checking my credit report I notice that there was a Default notice on my file dated October 2013. I am wondering if they are able to do this as firstly one was already issued in 2005, secondly I have been making payments on time each month as per the payment plan agreed and thirdly I have received no communication from Firstplus advising of any problem? Am I within my rights to ask for the Default to be removed from my credit report?
