  • Half rule help with final payment

    hi,

I've just returned a car to Moneybarn under the half rule due (I've made over 60% of the scheduled loan repayments) to changing circumstances. I contacted their customer service team on January 22nd by email requesting to terminate my agreement. I didn't get a reply so resent email on 25th. I finally heard from them on Jan 26th and was told SMA would collect car asap. SMA contacted me to say they could collect on Feb 4th which I took a day off work to facilitate. I made February's full payment on January 25th, as per my agreement. The car was collected on Feb 4th so I would expect a partial refund of February's payment as car was returned legally and following Moneybarns instructions. I spoke to asset management team at Moneybarn today who basically told me to bugger off; no refund forthcoming. The credit agreement I signed did not stipulate the retention of partial payments when the agreement is ended. do I have a valid claim or am I legally without a complaint?

    Thank you for your help!
