    I have a Lloyds account with a huge O/D. I have not used account for about 6 months nor have I made any attempt to reduce O/D.

    Have recently had communication from them (SCaM) saying they want a monthly payment which I agreed to. They wanted it on 29th of each month and I said I would pay it during first 5 days of each month in line with my income.

    This is the letter I sent:

    We write further to your letter of 19 May 2009 and my subsequent faxed acknowledgement to you today.

    We are writing to confirm that the sum claimed to be owing on the account referred to is currently in dispute due to the application of unlawful bank charges. This has been the case since June 2007 when we first queried the debt with Lloyds TSB. You will be aware that the disputed amount related to charges which are currently subject to the OFT v Abby & Ors test case due to be appealed at the House of Lords at the end of the month.

    You will also be aware that, under the terms of the FSA waiver on complaints handling given to the banks, the Banking Code and under Debt Collection Guidance published by the Office of Fair Trading (OFT664), Lloyds Bank plc may not default our account nor take further enforcement action whilst the debt remains in dispute. The disputed amount covers the entire sum alleged to be owing.


    In the interim and as a gesture of goodwill, as we are not intending to renege on our obligations to any debt which may be found to be owing, we are writing to offer payment of £200 per month in compliance with your letter of 19 May and trust this will be acceptable to Lloyds TSB and yourselves. We shall endeavour to make this payment regularly.

    We will be writing separately directly to Lloyds Bank reiterating the dispute on the account and request our complaints to be dealt with under the Financial Difficulties exemption in the FSA waiver.

    I paid last month by cheque and I went into the bank yesterday to pay in cash and I am now told that the account is closed and so they cannot accept the money! Great ... bloody great!!

    Any suggestions as to what I should write to them please?
