  • Trying to get a (HSBC) Charging Order removed on a sold debt to a DCA

    Hi,

My first visit to this site so appreciate any advice anyone can give me.

I had a CO applied by HSBC relating to a credit card debt back in 2009 and have been paying instalments ever since (and still am). Apparently they sold the debt some years ago to Cabot and I want to remortgage so need to get the CO removed. HSBC say they have sold the debt so can't help (I am still a customer!). I am awaiting Cabot's response but wanted to know a couple of things.

    1. This must have been supported by a CCJ but as it was 11 years ago there is no record of it
    2. I am happy to pay what the final amount outstanding is but only on the proviso that the CO is removed. it isn't in Cabot's name so they won't be able to do this for me

Where do I go from here? Can I ask the Registry Trust to have it removed? What proof will they need in order to do so and how long does it take?

I just seem to be stuck in the middle with no-one really taking ownership of the one thing I need; the CO removed. I will have paid the debt as it was never my intention to renege on anything I owed; it was just a difficult time.

    Any advice greatly received.

    Thanks

    Jeff
