Can a Scottish local authority ignore statutory guidance expanding on the social care (self directed support) (Scotland) Act 2013.
I've browsed web articles re guidance on guidance covering early and more recent case law, UK parliament committee, etc and am not sure whether the guidance can be ignored if it clearly expands on the objects and policy of the act
If a council wants to implement policies against the guidance does there have to be a record of a formal decision explaining why the guidance is not being followed?
Guidance seems to be allowed to be loosely written to allow users to adapt it to the circumstances of the specific case. A sort of official case law up front.
Can a council adopt a generic policy against the clear intentions of the guidance?
