My son has a 12yr old daughter from previous relationship who he has always seen regularly although his relationship with his ex has always been difficult. He has ALWAYS paid maintenance but for a few years he was unemployed and/or on very low income so was quite minimal during that time, in fact when he was unemployed he was not required to pay anything although he always did. He and his partner have their own family too now & he has recently qualified as electrician albeit he is still on apprentice wage but his ex applied for more money through CSA who confirmed he is currently paying correct amount for his daughter. However her recent application also prompted them to claim he owed his ex and the state from a few years ago.
He has subsequently proved with evidence what he paid his ex during that time which they have accepted and he owes his ex nothing but it seems she did not declare it at the time so she was overpaid by the state during this period. They are saying HE has to pay them back what they overpaid her as they won't chase her for it - this does not make sense or seem fair as surely she has made false claim which he was not aware of and had no control over resulting in her technically being paid twice.
He has asked for a breakdown of what he allegedly owes and the period involved but they seem reluctant to provide this. Where does he stand on this?
