My OH recently started his last 2 credit cards for PPI. He has just got over £4000 out of RBS, but he has an MBNA card which is well over 20 years old with PPI on. He sent off the letters and wasn't sure if he was self employed at the time he took out the card.
As it turns out they sent him a signed "application form", showing he put down an employers address, and that he, allegedly, ticked PPI.
Now, knowing that debts can't legally be collected upon a credit card provider only providing the "application form", I am wondering if this works the same way for PPI? If there is no signed credit agreement with the prescribed terms, can they use this "application form" to enforce PPI?
Surely, one could argue that as it is an application form, the applicant could have recinded the option to have PPI on any credit agreement?
The description of what PPI is on the application form is very thin and sparce and thus one could also argue he was miss-sold this as a full explanation was not given.
Any Legal Beagles who can explain the description of miss-selling of PPI and whether the "application form" is as tenuous for PPI and for the credit card debt itself?
