Voluntary termination

Hi, I have sent a letter to finance company saying I wish to voluntary terminate my hp contract, using a template letter, I gave them my contact details, to confirm they received my letter, which they did, they said they could do me a deal prolonging my finance, once I told them no, they asked if the vehicle has 12 months mot, as they won't accept the vehicle back unless, is this correct? The vehicle's mot has run out by a day, do I need to get it mot'd?
