  • Form E and mediation

    Hi

    Can someone please advise me in the following scenario:

    1. We have been to one shuttle mediation to discuss finance. The mediator asked us fill in provision disclosure and I stated the truth. I think the ex hasn't said anything. The information is not shared with either of the parties by the mediator at this stage as this is for mediator reference only.

    2. In the next mediation we will be required to fill in Form E. I suspect (I am saying this based on the correspondence I am getting from her solicitor) that she will lie on Form E. It is a high possibility that neither of us will come to an agreement regardless what is being said on Form E.

    3. In the next mediation if I am not being truthful on Form E and the mediation fails and either of us go to court and I say the truth as part of court proceedings, does the fact that I lied in mediation about Form E be referred to or go against me? Equally can I refer to what she said on Form E is a lie to in mediation?

    4. Can the mediator question me in the next mediation why the amount of disclosure is different on Form E compared to the one in the next mediation? I am literally planning on going for only one more round of mediation.
