  • Lowell Court claim for debt bought from Citi/Opus

    I have a very old debt which Lowell have issued a claim against. I am more sure than not, that it's Statute barred but can't prove it.
    My credit file confirms that the account was opened in 2003. However, Lowell are claiming a default day in Aug 2012. This was never theirs to make such a claim. I cannot recall receiving any such default in 2012.
    I believe I haven't acknowledged or paid for the debt in over 7 years but can't prove it. Past dealings with Lowell when requesting SAR have resulted in them saying they don't need to provide it.
    What is my best course of action without proof of last payment. How can Lowell issue a default when presumably the original default was issued by Opus pre 2010?
