I have been contacted by Mortimer Clarke threatening court action. I have responded by stating that I believe this matter to be statute barred which was sent by recorded delivery. They have since written to me stating that the last payment of £26.38 was made on the 30.12.15 but I have not paid anything nor does my bank account reflect such a payment. Judging by their references they have already referred this to the Court as there is a case number attached to the letter.
Can you tell me what I can do from here please? Also since the debt was accrued by name has changed - will this affect anything? I have checked on my credit file but can only pull things up under my current name and not former as all of my bank details reflect the new name therefore cannot see if and when the last payment was made but it certainly wasn't last month!
