I would be most great-full if someone could point me in the right direction.
I had an Options hearing scheduled for 7th January In Aberdeen Sheriff Court, i had made a CPR request to Optima Legal & a CCA request to Cabot Financial upon receiving the writ, i received no reply from Cabot, but i received a reply from Optima Legal who indicated they had requested the information from Cabot & that would i sign & return a joint motion to sist the action to allow these documents to be forwarded to me, i signed & returned the joint motion to Optima Legal, i heard nothing more for weeks & decided as the options hearing was a week away to contact the Sheriff Court to find out what the status of the case was, i was informed it was still set for 7th January, i straight away sent a letter to Optima to ask why they had not lodged the joint motion to delay the hearing, they informed me that the initial joint motion was returned to them by the sheriff clerk because it was a photo copy they had sent, Optima then sent me another joint motion to sign & return to them & stated they would attend the options hearing on the 7th January & lodge the motion to sist the action & that i need not attend the arranged options hearing. 2 Days after the 7th January i received the letter attached from Optima Legal stating the Sheriff had not granted the joint motion to delay & that the Sheriff ordered me to submit a written note of my defence by the 14th January. Can any one help me with how i write this note & how i do it
