  • Optima again

Optima on behalf of MBNA got a CCJ against me in May for £7800. The judgement was monthly installments of £79.81. At the time I was unemployed and so applied for redetermination. The hearing was scheduled for 9th Aug. In the meantime I got a job and so cancelled my appeal. I then received an order saying after reading my cancellation for redetermination that the judgement should be paid forthwith. Optima have now applied for a charge against my property. Since starting work I have paid monthly installments of £77.91 and these payments are up to date. Optima have accepted the payments. The application for charge on my house states that the judgement or order did not provide for monthly payments. The original judgement did provide for mothly installments, I have since paid the amount ordered monthly, Optima have accepted these payments and the account is up to date. Is the original judgement still in force or can they insist that the full amount is now due. Is it likely that they will get a charge on my house and if they do will I have to sell my house. As a way out of this mess, with a CCJ do you think my building society consider a second mortgage to pay off this debt
