  • Cavity wall insulation claim

    Hi all, I live in the UK.
    This is my first post to this forum, so please be gentle with me.
    I wish to make a claim against the installer of cavity wall insulation. I have been dealing with CIGA, the guarantee company, and they have a provision for using arbitration. However, according to the conditions, I can only claim to have damage rectified and a maximum of £100 for time and inconvenience, but if I took my claim to the county court, I could claim much more. I am reasonably confident of winning the claim, but I'm not sure whether the judge will make me pay court costs since I had the opportunity to use arbitration but didn't take it. Can someone please advise me? I would be very grateful.
