  • Dwf solicitors instructed by moneybarn to recover my hp car

Hi I'm looking for some advice . So took a car out on finance I've paid half of it off prior to this I had some struggles and ended up missing payments , applied for a time order and it was granted on the basis that I increased my monthly payments by 100 pounds to take my account out of arrears so i got my head down and took on a second job in a bar as well as my 40 hour a week "day job" , I was under the impression that my payments would go back to the agreed payment amount as per my initial agreement but upon checking with moneybarn apparently this wasn't the case and insisted I continue paying the additional 100 per month , this would mean I would have paid my car off months before my agreed repayment period. By this time I was completly knackered from my evening job I'd never suffered from any mental health issues in my life (I'm 43) I had to stop the second job I was just burnt out, fast forward a few months and I'm now awaiting an nhs adhd assessment cause I have just not been functioning very well and I do think this is the straw that broke the camels back so to speak it was when I looked back at all the missed payments and letters that I just felt so much shame I though this can't be the way everyone lives their lives and it really pushed me to do something about it, I emailed money barn as I had broken my time order by missing payments, the email I recieved back was to inform me they had passed my case on to dwf legal and I'd need to email them, my heart dropped and I emailed them to which they replied asking for some security Info the usual , name D.O.B address and postcode which I gave, they then replied saying the adress did not match what they had on file, I then replied with an old address from over 2 years ago , which the accepted . The second reply was basically our client moneybarn has requested we reposess the vehicle due to missed payments, my question is I've paid half my car so do they need to get a court order? Also is there anything else I can do to fight this ( I am unable to pay the early settlement figure and I've no family to borrow from), any helpfull advice would be great thank you
