    Hi there,

    I am wondering if anyone could give me some advice please?

    I secured a used automatic car from a local dealer on 06/05/24, using a credit card for the deposit (£400). The final balance was paid on 09/05/24 via bank transfer (£3350). I understand I have section 75 protection due to using a credit card for the deposit.

    On 18/05/24, only nine days after collecting the car, an intermittent gearbox fault surfaced. On occasions the car would not engage into drive, on other occasions the car would go into neutral while driving. This was obviously dangerous. I contacted the dealer immediately and the car was collected on 31/05/24 for a gearbox service. Car returned on 03/06/24.

    On 24/06/24 the intermittent gearbox issue resurfaced, happening five times on my way home.

    Again, I contacted the dealer and told him of the issue. After having to chase him up on six separate occasions, the car was eventually collected on 01/07/24. I was told it would be having a brand new gearbox fitted under warranty.

    It is now 30/07/24, they have had the car for 29 days, I have chased them up every week, and the issue still is not resolved.

    Legally, have I given them long enough to resolve this? I have kept a detailed account of our communication. I am getting to the stage where I want to return the car for a refund. Their communication has been almost nonexistent and I don't believe this will be fixed properly.
