I am trying to buy a house for the first time in a number of years and want to appoint a Surveyor to complete a level 2 housing survey.
The contract has a clause which states "We shall not be liable to you in negligence for pure economic loss arising in connection with the performance or contemplated performance of the Services".
Does this mean that, if the Surveyor misses something or mis-states something in their report due to negligence, I can't subsequently claim against them?
If this is the case, does that mean that they effectively are excluding all potential liability from our agreement?
The reason I ask is that, if this is indeed the case, I don't understand what recourse I have against them contractually in the event that they act negligently in the course of their work.
