Hi team,1st time poster but have been using this invaluable site for a while. Read a few of the posts on reconstituted agreements, mine was with Barclaycard and provided by PRA. Background - account opened 2011, defaulted 2017. The issue I have is on the reconstituted agreement PRA received from Barclaycard used my married name, however the account was opened prior to my marriage. I raised this with PRA as the FCA handbook says it needs to be name and address at time of execution. PRA went back to Barclaycard who said the account was opened in my married name which is not true. No statement of account was provided as they can only get statements from 2014. Would the account be unenforceable on the basis that they don’t have the correct name under which the account was opened?
