  • Delayed Setting Aside of a CCJ

    My partner had a default judgement for a previous address against her early 2021. We didn't know about this until Dec 2021 when a bailiff appeared at the door. The debt is now satisfied, but we're looking to get it set aside (hopefully with consent) due to my partner being entirely confident that she never received any correspondence about any hearing where it was decided, although the claimant will have known about the change of address. I can vouch for that, as we had been sharing a property for nearly 6 months prior.

    We were not in a position of mental capacity to try and get it set aside when we initially found out in December due to work and financial struggles (with a large bill from a bailiff then piled on top) - have we left this too late? What are the chances the court will allow the CCJ to be set aside if we gain consent from the claimant?

    Any help is appreciated.
