  • Can a company raise a default and legal action for a falsely made up debt?

The background in brief is as follows:
In July 2020 I requested disconnection of my gas supply and removal of my gas meter. I paid Cadent to disconnect the property from the gas main which they did in October. After much wrangling I finally got Scottish Power to remove my meter on 2 November 2020. I agreed settlement and closure of my account, which they didn't do so I took my complaint to the Ombudsman who ruled in my favour and both I and Scottish Power agreed the settlement which resulted in my gas account being closed effective 2 November 2020 and they refunded the balance they were holding. This should have been the end.

However, they opened a new account (new number) in the name of the Owner/Occupier and they are now aggressively chasing the Owner/Occupier for payment and are now threatening debt collectors and raise a default, and if necessary court action. This new account is 100% fabricated. I did not sign any agreement with them; the property does not even have a gas supply nor gas meter; the account is in the name Owner/Occipier.

Should I be concerned (other than the stress of the ongoing harassment)? Can they raise a default without a signed utility agreement? Can they do this even though the property is not connected to the gas main?

I would welcome thoughts on how best to handle this. The ombudsman is not being helpful.
    Many thanks
