  • Child's inherited interest in a property

    My father died intestate and after a nasty legal dispute in which my siblings tried to bully me into giving up my share of the estate a consent order was drawn up. The agreement was that I would give up my one-third share of my father's 50% interest in a property in return for a 50% share of all his other assets and that the whole of my father's 50% share would go to my 3 children who, at that time were all minors. The Consent Order said that my 2 siblings and the owner of the other half of the property would be trustees. The other 3 parties would not agree to me being a trustee for purely vindictive reasons. Two of my children are now over 18 and the other is 14. My children's share of the property is still registered in the name of my deceased father and my two elder children wish to register their interest in the property with the Land Registry. All 3 of my children are happy for me to be nominee for my younger child's interest and I think this is an important move to protect the asset for them. My concern is that the other 3 parties who, have not done as was agreed in the Consent Order may be able to object. Neither of my two siblings live in the UK and the owner of the other 50% of the property is over 80, and they would all prefer it if, the other owner of the property were able to leave it to their own children and I believe that this is their intention. Would they have any legal success if, they objected to me being the nominee, 15 years on having done nothing about it themselves during those 15 years?
