  • Small Claims Court - Van Purchased

    Evening,

    I am writing this in the hope of some advice regarding the situation I’m currently in.

    I purchased a van in March of 2020 last year from a small used vehicle dealer about 2 hours away.

    The van from the eye looked exactly what I wanted and was advertised with full service history. Once a price had been agreed which was £2000. The owner of the company told me that because of where he had purchased the van from, the service history was in transit and would be posted to me once it had arrived to the premises.

    After following up numerous times I never got a reply and still now I haven’t received any service history.

    Today was the day I took my van for it’s yearly MOT. And it has failed with major defects which have clearly been bodged by the seller. The sills on the van were ridden with rust and had big holes filled with foil and filler then painted over to make it seem that they were all okay.

    The issue I have is that clearly the major defects haven’t occurred within the year of me owning the vehicle and I haven’t been sold the road worthy car I thought I’d purchased.

    The previous years MOT there is nothing in regards to any of the major defects that have been found this year and it pretty much passed without anything major.

    I want to take the business to the small claims court. But only if I can get the right advice on the situation as this is something out of my comfort zone
