  • Paying by Instalments and CCJ

I received a County Court claim pack yesterday for a short term loan taken out in September 2020 for £500.

I was in between work at the time and could not make the payments. Due to the pandemic I had to move home temporarily and did not get in contact with them till December 2020 when I went through my letters by then the loan had defaulted already.

I asked them for a statement of account and contacted them again in January 2021 making an offer of payment. They sent me an income and expense form to populate although I could not open the file I replied telling them this and my offer but I did not here a response.

I rang them 2 weeks later and they said they could not agree to a plan without an income and expense form and I need to complete one online. I had not got round to do it and received a county claim form.

The debt has now gone up to 1060 which I cannot afford to pay in one go. If I pay in installments and respond to the form I will receive a CCJ which will effect my future employment.

Is there anyway I can pay in installments without a CCJ being recorded against me. i spoke to the creditor this morning they offered me a settlement figure of 901 but that is still too high for me to pay all in one go

My understanding is if you pay the balance within a month of the letter no CCJ is recorded but if you admit and ask to pay in installments after a month a CCJ gets recorded

    Can anyone advise please
