  • After a set aside is granted?

    Hello

    Hypothetically, if I submit an N244 for a set aside without consent and this was granted on the basis that I have acted promptly/evidenced a real prospect of defending the claim, do I actually have to then defend the claim?

    I.e. could I have the CCJ set aside due to showing that I ‘could’ defend the claim and then after the set aside has been granted choose instead to settle the debt with the claimant instead of filing a defence?
