i know this has been asked a few times so i do apologies.... VT and mileage fees

so i took out a smart car on pcp in september 2017. for four years it ends in sep 2021. i made payments of 132 every month the value of the car was 7000 etc

my mileage was 42k i have done 48k... i have decided to vt however i am wondering according to cca 1974 am i still within my rights not to pay for mileage?
