  • Defamation of character

Hi all, I'm really pleased to have stumbled upon your website. I hope you can help us out...

My daughter has additional needs, diagnosis ASC/ADHD, and as part of her EHCP I requested a disabled child's assessment which is carried out by social services.
They called me and had 1 telephone conversation with me, and apparently they had all my daughter's professional reports. This week I received the final report and it was horrible to read. Firstly it's all written as if they talking to my daughter, a minor.
In part of it, it states:

"Your mum described you as 'horrible' and 'I need time away from her so I can just be with J' (my husbands name) 'her behaviour is exhausting' 'I'm at the end of my tether'."

Later on she remarks on how my husband doesn't appear to be present and that it is as if I'm a single parent.

I was so shocked as I knew I didn't say those things and my husband is amazing and supportive. The only time I mentioned him not being present is between 3pm - 6pm when he finishes work in the week.
When we had the telephone conversation 2 weeks ago I happened to be next to our doggy cam, which recorded the whole conversation as it's on 24/7. I listened back and can prove I didn't say these things.

I've emailed her managed stating I'd like to make a formal complaint about her interpretation of our phone call.
He's agreed to meet in person to discuss this.

I've today written a transcript from the recording and will take that along with me.

But, is this defamation of character?
They have sent this report to the SEN department already as I am currently appealing against her EHCP as she needs to be in a specialist provision (which the school have put her in) but the LA refuse to name it in section I.

    Hope that makes sense.
