  • Hello, N181 advice please

    Thank you for letting me join the community. I really need some help urgently with the N181 form which needs to be in soon. I'm a freelancer and am owed money from a small limited company which I worked for. I have completed a claim via MCOL which has been defended. It is in the Fast Track stream due to being over £10K and I'm completing the Directions Questionnaire (N181). I have a question about section J, if anyone could help, please? I potentially have a witness (another freelancer who has not been paid either). Can they provide a written statement for me? Do I have to mention them at this stage? Do I put myself as a witness? I have sent standard fast-track directions to the Defendant. The Defendent and myself are talking of settling the claim and will ask for a month's stay on the form. To further complicate matters, if we don't reach a settlement, I need to move the claim to the small claims court as can't afford the fees and there is a chance that the company might just close adn I won't get any money. I telephoned the court and they said I could complete a N244 Application Notice and produce an amended N1SDT Claim Form so that a judge can decide to move the claim down. Does that sound correct? Thanks so much for your help.
