  • Consenting set aside.

    Hello. Hoping you can help.
    Was given a CCJ March 2018 without knowing about it by CEL. Parking ticket sent to old address after Apr 2017. We left the house in May 2017. We had a mortgage and loans and changed our licences so could have easily been found.
    We didn't update our V5 until we found out about the CCJ in Sept 2019. Contacted the court. And CEL. Was told by CEL that they would accept 197 pounds payment reduced from the 350 pounds. And if we pay 100 to the court they would consent to a set aside.

    We did not understand what all this meant and so did not contact CEL again until now when we found out about what a set aside meant. So we didn't act promptly. Anyway we asked them if they would consent to a set aside or we would go for a contested set aside and defend.

    Anyway they said they made attempts to find us and they original offer still stands.

    My question is if we pay and go for the consented set aside. CEL said they will send a draft consent order. Will the judge actually set it aside?
    Trying to avoid having to defend the fact we did not do much about it (lack of understanding) when w
    e originally found out nad haven't really got the time.
