  • Redundancy; Fair or Unfair?

    Hi All,

    After being inform back in June by email letter the my job was at risk of redundancy, I finally had my one and only consultation on Wednesday. I have been told I have been selected based on last in first out, or as they worded is “length of service.”

    The previous week I received a call from my senior manager to book the meeting and was told LIFO was an option but hadn’t been confirmed. However, a few days later, and before the meeting, my direct manager called me to wish me all the best for the future and thank me for all my hard work, thus confirming my redundancy... despite not yet having my consultation.

    One of my colleagues has been requesting to step down from the role for 12+ months due to elements he struggles with, however, they’ve not actioned it. I mentioned it during my consultation and they told me it would be handled separately now as there are no other roles to offer him.

    During the consultation, I suggested re-interviewing for our jobs however I was told “We considered that but then decided it wasn’t fair as a really good colleague could have a bad day and not fair well at the interview.” My somewhat surprised response was “Is that not the case with any interview? If you don’t perform well then you don’t get the job... that’s just bad luck?!”

    Additionally, when I received the letter of redundancy, my job title was wrong It was similar, but not as per my contract. On top of that, some of my colleagues received an identical letter, however were told their job was not at risk, despite having the same job title - I am/was part of a training team and some trainers looked after one area whilst others looked after another, however in our contracts we all have the same job title.

    Also just to add, looking through my contract it mentions that any salary adjustments will be notified at least one month in advance. When COVID kicked off we were forced to take a pay cut almost immediately (from 1st April) however we didn’t receive any written communication of this until 10th April. I have also been furloughed since 1st April to present, bar 2 weeks back at work to complete refresher training for colleagues to get them back online.

    Anyhow, it’s not been confirmed with another email letter that I’ve lost my job and my employment will end in mid-September. They’ve stated in the letter than I can immediately sign a fixed term contract until 31st October, without any benefits of course, in order to continue getting the 80% furlough pay for another month... is that even legal? Signing a “contract of re-engagement” immediately after being made redundant even though I’m furloughed.

    Any help/advice would be greatly appreciated. Thank you.
