  • Robinson Way Letter

    Hello,

    Just the other day I received a letter from Robinson Way after two plus years and some copies of card statements (2008-2010) and a photo copy of the original credit card application which I initially signed with Nationwide. Please find attached copy of this letter, a copy of Notice of Assignment, posted on December 2018.

    You will notice that in January 2018 I sent a CCA to Robinson Way and also asked the original lender Nationwide for SAR, which I received sometime in February 2018. I also attach a letter from Robinson Way acknowledging that that they had received my request and they will be providing the documents once obtained. So, they will put an hold to my account.

    Well, that day has arrived and after two plus long years they sent me some paperwork for payment proposal and will hold my account for 30 days until they hear from me.

    Now, looking at the SAR from Nationwide I notice that the last payment on the card I made was on April 2014. So, little more than 6 years have elapsed. Wouldn’t this be statute barred?

    I would appreciate if you could advice me what kind of respond shall I prepare for Robinson Way.

    Just a bit of history on this debt: I received a Letter of Claim from Howard Cohen & Co. Solicitors in January 2018 regarding Ex. Nationwide Credit Card which has been sold many times over the years. The last debt collector was Robinson Way. They have been sending mail to me for the last several months in 2016/2017. This letter states that Robinson Way purchased the debt and was legally assigned on 4/4/16 and is acting for Hoist Portfolio Holding 2 Limited, apparently the Notice of Assignment was provided to me which I have no recollection. I have had no correspondence/conversation of any kind with Robinson Way or with any other debt collectors. Howard Cohen has given me until February 8, 2018 to respond to the letter or they will instruct the County court to issue Claim for the balance of the card. Well, which I mention on the first paragraph and CCA and SAR was sent accordingly.
