Is this common law crime an appropriate charge to use against people whose crime was to go hillwalking more than 5 miles from home. A breach of Scottish Govt guidelines which are not law.
It looks like since there was no Conavirus law that could be used the police just looked for a catchall. This is usually used for conduct that has caused or was very likely to cause injury. Like selling glue sniffing kits, throwing cones off bridges, tampering with medicine, failing to disclose sharps before being searched.
